DISTANCES LĪGUMS
Šis līgums tiek noslēgts starp Interneta vietnes īpašnieku (turpmāk – Izpildītājs) un fizisko vai juridisko personu, kas veic pakalpojuma rezervāciju vai pirkumu Interneta vietnē (turpmāk – Klients).
1. Vispārīgie noteikumi
1.1. Šis līgums nosaka kārtību, kādā Klients pasūta, apmaksā un saņem fotokalpojumus vai saistītos produktus Interneta vietnē. 1.2. Veicot pakalpojuma rezervāciju vai apstiprinot pirkumu, Klients apliecina, ka ir iepazinies ar šī līguma noteikumiem un tiem pilnībā piekrīt.

3. Pakalpojumu pasūtīšana un cenas
3.1. Visas pakalpojumu cenas Interneta vietnē ir norādītas eiro (EUR). 3.2. Izpildītājam ir tiesības jebkurā brīdī mainīt norādītās cenas bez iepriekšēja brīdinājuma. Pirkumam vai rezervācijai tiek piemērota cena, kas ir spēkā pasūtījuma noformēšanas brīdī. 3.3. Pakalpojuma rezervācija tiek uzskatīta par apstiprinātu ar brīdi, kad Klients ir veicis saskaņoto avansa (rezervācijas maksas) vai pilnas summas apmaksu.
4. Apmaksas kārtība
4.1. Par pakalpojumu Klients norēķinās priekšapmaksas veidā, izmantojot Interneta vietnē pieejamos maksājumu risinājumus (tostarp bankas maksājumu kartes vai internetbankas pāradresācijas maksājumus). 4.2. Maksājumu apstrādi un drošību nodrošina AS SEB banka un tās e-komercijas maksājumu platforma. Izpildītājs nesaglabā un neapstrādā Klienta maksājumu karšu datus.
5. Pakalpojuma rezervācija un Avanss (Rezervācijas maksa)
5.1. Veicot fotopakalpojumu rezervāciju konkrētam datumam un laikam, Klients veic avansa iemaksu (turpmāk – Rezervācijas maksa). 5.2. Rezervācijas maksa kalpo kā garantija noteiktā datuma un laika rezervēšanai par labu Klientam, kā arī sedz Izpildītāja administratīvos un sagatavošanās izdevumus. 5.3. Klienta iniciētas atcelšanas gadījumā iemaksātā Rezervācijas maksa netiek atmaksāta. Tā tiek paturēta kā kompensācija par Izpildītāja dīkstāvi un plānošanas resursu izmantošanu saskaņā ar Civillikumu. 5.4. Ja pakalpojums netiek sniegts Izpildītāja vainas dēļ vai nepārvaramas varas (Force Majeure) apstākļu dēļ, Izpildītājs atmaksā Klientam saņemto Rezervācijas maksu pilnā apmērā.
6. Atteikuma tiesības un izņēmumi (Patērētājiem – fiziskām personām)
6.1. Saskaņā ar Latvijas Republikas Ministru kabineta noteikumu Nr. 255 (Noteikumi par distances līgumu) 22. punktu, atteikuma tiesības (14 dienu atteikšanās no līguma) netiek piemērotas:
Pakalpojumiem, kas tiek sniegti noteiktā datumā vai laika posmā (piemēram, pasākumu, kāzu vai individuālās fotosesijas rezervācija konkrētā datumā);
Digitālajam saturam vai fotomateriāliem, kas tiek izgatavoti pēc Klienta individuāla pasūtījuma vai specifikācijas. 6.2. Gadījumos, uz kuriem atteikuma tiesības ir attiecināmas, Klients var izmantot atteikuma tiesības 14 dienu laikā, nosūtot rakstveida paziņojumu uz e-pastu: [email protected]. 6.3. Juridiskām personām atteikuma tiesības netiek nodrošinātas.
7. Datu apstrāde un privātums
7.1. Klienta personas dati tiek apstrādāti atbilstoši Vispārīgajai datu aizsardzības regulai (GDPR) un spēkā esošajiem Latvijas Republikas normatīvajiem aktiem. 7.2. Personas dati tiek izmantoti tikai pasūtījumu apstrādei, pakalpojuma izpildei, grāmatvedības uzskaitei un saziņai ar Klientu. Dati netiek nodoti trešajām personām, izņemot sadarbības partnerus, kas nodrošina maksājumu apstrādi (AS SEB banka).
8. Strīdu risināšana
8.1. Visas domstarpības un strīdi tiek risināti savstarpējo pārrunu ceļā. 8.2. Ja vienošanās netiek panākta, strīds tiek izskatīts Latvijas Republikas tiesā saskaņā ar Latvijas Republikā spēkā esošajiem tiesību aktiem.

DISTANCE AGREEMENT
This Agreement is entered into between the owner of the Website (hereinafter – the Service Provider) and the natural or legal person placing an order or booking a service on the Website (hereinafter – the Client).
1. General Provisions
1.1. This Agreement defines the procedure by which the Client orders, pays for, and receives photography services or related products on the Website. 1.2. By booking a service or confirming a purchase, the Client acknowledges that they have read, understood, and fully agree to the terms of this Agreement.

3. Ordering Services and Pricing
3.1. All service prices on the Website are displayed in Euros (EUR). 3.2. The Service Provider reserves the right to change prices at any time without prior notice. The purchase or booking will be charged according to the prices valid at the time the order is placed. 3.3. A service booking is considered confirmed once the Client has made the agreed advance payment (booking fee) or paid the full amount.
4. Payment Terms
4.1. The Client pays for the services in advance using the payment methods available on the Website (including payment cards or internet banking redirection links). 4.2. Payment processing and security are provided by AS SEB banka and its e-commerce payment gateway. The Service Provider does not store or process the Client’s payment card details.
5. Service Booking and Advance Payment (Booking Fee)
5.1. Upon booking photography services for a specific date and time, the Client pays an advance payment (hereinafter – the Booking Fee). 5.2. The Booking Fee serves as a guarantee to reserve the specified date and time exclusively for the Client, as well as covers the Service Provider’s administrative and preliminary planning expenses. 5.3. In the event of cancellation initiated by the Client, the paid Booking Fee is non-refundable. It is retained as compensation for the Service Provider’s date reservation, planning resources, and lost business opportunity in accordance with the Civil Law of the Republic of Latvia. 5.4. If the service is not provided due to the fault of the Service Provider or due to Force Majeure, the Service Provider shall refund the received Booking Fee to the Client in full.
6. Right of Withdrawal and Exceptions (For Consumers – Natural Persons)
6.1. Pursuant to Clause 22 of Cabinet Regulation No. 255 of the Republic of Latvia (Regulations Regarding Distance Contracts), the right of withdrawal (14-day cooling-off period) does not apply to:
Services provided on a specific date or period of time (e.g., booking of event photography, wedding photography, or individual photo sessions for a specific date);
Digital content or customized materials produced according to the Client’s individual specifications. 6.2. In cases where the right of withdrawal applies, the Client may exercise it within 14 days by submitting a written notification to: [email protected]. 6.3. The right of withdrawal is not applicable to legal entities.
7. Data Processing and Privacy
7.1. The Client’s personal data is processed in compliance with the General Data Protection Regulation (GDPR) and applicable legislation of the Republic of Latvia. 7.2. Personal data is used solely for order processing, service delivery, accounting compliance, and communication with the Client. Data is not shared with third parties, except for service partners facilitating payment processing (AS SEB banka).
8. Dispute Resolution
8.1. Any disputes or disagreements shall be resolved through mutual negotiations. 8.2. If an agreement cannot be reached, the dispute shall be submitted to the courts of the Republic of Latvia in accordance with the laws of the Republic of Latvia.
